Nothing in these Terms is intended to conflict with the provisions of your issued insurance policy where such policy provisions are mandated by state law or approved by the applicable state insurance commissioner. In the event of a direct conflict between these Terms and the terms of a bound insurance policy, the policy terms shall control with respect to coverage, exclusions, limits, deductibles, and claims handling, except where prohibited by law.

Our Services include, but are not limited to, the distribution of personal auto insurance, commercial auto insurance (where available), liability coverage, collision coverage, comprehensive coverage, uninsured and underinsured motorist protection, medical payments coverage, personal injury protection (in no-fault states), roadside assistance, towing services, rental car reimbursement, and other optional coverages as permitted by applicable state law.
Through our Site and affiliated channels, we offer online quote generation tools that allow prospective customers to obtain estimated premium pricing based on information you provide regarding your vehicle, driving history, garaging location, coverage preferences, and other underwriting factors. We also provide policy enrollment and binding capabilities, online account management, digital policy document delivery, premium payment processing, claims intake and status tracking, educational resources about auto insurance, and customer support services.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services, except as expressly required under your active insurance policy or applicable law.
To use certain features of our Services, including obtaining binding quotes, purchasing policies, managing your account online, and filing claims electronically, you must register for an account and provide accurate, current, and complete information as prompted by our registration forms. You agree to maintain and promptly update your account information to ensure it remains accurate, complete, and current at all times.
Eligibility for auto insurance coverage through Coskun Auto Insurance is subject to underwriting guidelines that vary by state and product. General eligibility requirements include, but are not limited to: holding a valid driver's license or qualifying permit as permitted by state law; maintaining legal ownership or insurable interest in the vehicle to be covered; residing in or garaging the vehicle in a state where we are licensed to write business; meeting minimum age requirements (typically sixteen years of age with a valid license for listed drivers, though policyholders must be at least eighteen); and satisfying our underwriting criteria regarding driving record, claims history, credit-based insurance scores (where permitted), vehicle type, and annual mileage.
When creating an account, you will be asked to select a username and password or authenticate through approved single sign-on methods. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, whether authorized by you or not. You agree to notify Coskun Auto Insurance immediately at contact@coskunotomotivtrabzon.com if you suspect any unauthorized access to or use of your account. We will not be liable for any loss or damage arising from your failure to safeguard your login credentials.
You may not create an account using a false identity, impersonate another person, use an email address or username that you do not have the right to use, or create multiple accounts for deceptive or abusive purposes. We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion if we believe you have violated these Terms, provided inaccurate information, engaged in fraudulent activity, or pose an unacceptable underwriting or security risk.
For household policies covering multiple drivers, the named insured is responsible for ensuring that all listed drivers meet eligibility requirements and that information provided about household members is accurate. Failure to disclose all regular drivers, household residents of driving age, or material changes in driver status may result in policy cancellation, claim denial, or premium adjustment retroactive to the policy inception date, as permitted by applicable state law.
Insurance quotes provided through our Site, mobile applications, customer service representatives, or partner channels are estimates based on the information you supply at the time of the quote request. Quotes are not offers of insurance and do not constitute a binding agreement until all of the following conditions have been satisfied: (a) you have submitted a complete and accurate application; (b) we or our underwriting partners have verified the information provided; (c) you have paid the required initial premium or established an approved payment plan; and (d) we have issued a policy or binder and delivered confirmation of coverage to you.
Premium amounts displayed during the quoting process are subject to change based on additional information obtained during underwriting review, including but not limited to motor vehicle reports (MVRs), comprehensive loss underwriting exchange (CLUE) reports, credit-based insurance scores, vehicle identification number (VIN) verification, prior insurance history, undisclosed drivers or vehicles, changes in garaging address, and adjustments required by state regulatory filings. A final premium will be reflected on your declarations page and billing statements.
Coskun Auto Insurance makes no warranty or representation that a quote will remain available for any specific period. Quoted rates may expire after a stated validity period (typically seven to thirty days depending on state regulations) or upon changes in our rate filings, underwriting guidelines, or applicable law. We reserve the right to decline to issue a policy even after providing a quote if underwriting review reveals information that differs materially from what was disclosed during the quoting process.
Temporary coverage may be provided through a binder or evidence of insurance document in certain circumstances pending issuance of the formal policy. Binder terms, duration, and conditions are governed by state law and our internal procedures. A binder is not a substitute for a fully issued policy and may be subject to cancellation or modification upon completion of underwriting review. You are responsible for confirming that your coverage is active and that you have received all required policy documents before operating your vehicle.
Any tools, calculators, coverage comparison charts, or educational content on our Site are provided for informational purposes only and do not constitute legal, financial, or insurance advice. Coskun Auto Insurance is not responsible for decisions you make based on preliminary quote information that has not been confirmed through the formal application and binding process.
Premium payments for Coskun Auto Insurance policies must be made in accordance with the payment plan selected at enrollment or subsequently approved by us. Available payment options may include payment in full, semi-annual installments, quarterly installments, or monthly installments, depending on your state of residence and policy type. All payment plans are subject to applicable installment fees as disclosed at the time of purchase and on your billing statements.
By enrolling in a policy and selecting a payment method, you authorize Coskun Auto Insurance and our designated payment processors to charge your credit card, debit card, bank account (ACH/electronic funds transfer), or other approved payment method for premiums, fees, and applicable taxes on the scheduled due dates. For recurring payment plans, this authorization continues until your policy is cancelled or you revoke authorization by providing written notice in accordance with our billing procedures, subject to any minimum earned premium or outstanding balance obligations.
If a scheduled payment fails due to insufficient funds, expired payment method, account closure, or any other reason, we will attempt to notify you and may retry the payment in accordance with our collections procedures and applicable law. Repeated payment failures may result in late fees (where permitted by state law), suspension of optional coverages, cancellation of your policy for nonpayment, and reporting to credit bureaus or state motor vehicle departments as required by law. You remain responsible for all premiums owed for the period during which coverage was in effect, including any minimum earned premium specified in your policy.
Premium adjustments may occur during the policy term due to endorsements, added or removed vehicles, driver changes, mileage updates, coverage modifications, rate revisions approved by state regulators, or discovery of inaccurate information. When a mid-term premium adjustment results in additional amounts owed, you agree to pay the adjusted premium within the timeframe specified in our billing notice. Failure to pay adjusted premiums may be treated as nonpayment and subject to the cancellation provisions of your policy and applicable state law.
All premium payments are denominated in United States dollars. We do not accept cash payments through the Site. Refund processing for eligible cancellations and overpayments is addressed in Section 6. If you believe a billing error has occurred, you must notify us within sixty (60) days of the billing date by contacting contact@coskunotomotivtrabzon.com with your policy number, a description of the disputed charge, and supporting documentation. We will investigate and respond within the timeframe required by applicable law.
Either you or Coskun Auto Insurance may cancel your auto insurance policy subject to the terms of your policy contract and the insurance laws of the state in which the policy was issued. Cancellation procedures, notice periods, and refund calculations vary by state and policy type. The following general principles apply unless superseded by your policy documents or mandatory state provisions.
If you wish to cancel your policy, you may submit a cancellation request through your online account, by email to contact@coskunotomotivtrabzon.com, or through other methods specified in your policy documents. Your cancellation request should include your policy number, the desired cancellation date, and the reason for cancellation. Cancellation becomes effective on the date specified in your request or on a future date agreed upon by both parties, subject to any minimum retention period or earned premium requirements. You may be required to provide evidence that alternative coverage has been obtained if required by your state's financial responsibility laws.
Coskun Auto Insurance may cancel or non-renew your policy for reasons permitted by applicable state law, which may include but are not limited to: nonpayment of premium; material misrepresentation or fraud in the application; substantial increase in hazard; loss of insurable interest; revocation or suspension of a listed driver's license; failure to comply with policy conditions; or underwriting reasons permitted during the initial policy period as defined by state statute. We will provide advance written notice of cancellation or non-renewal in accordance with state-mandated timeframes, typically ranging from ten to sixty days depending on the reason for cancellation and applicable regulations.
Refund eligibility upon cancellation depends on the reason for cancellation, the timing within the policy period, and state-specific rules regarding short-rate versus pro-rata return premiums. When you cancel voluntarily, some states allow insurers to apply a short-rate penalty that results in a slightly reduced refund compared to a straight pro-rata calculation. When we cancel for nonpayment or other permitted reasons, refunds, if any, are typically calculated on a pro-rata basis for unearned premium, minus any outstanding balances, installment fees, or minimum earned premium. No refund is owed for periods during which coverage was provided and premium was fully earned.
Refunds will be issued to the original payment method or by check to the named insured at the address on file, within the timeframe required by state law (typically fifteen to thirty days after the effective cancellation date). If you have an outstanding balance at the time of cancellation, the refund amount will be offset by amounts owed. Chargebacks or payment disputes initiated through your financial institution do not constitute valid cancellation requests and may result in additional fees, policy cancellation, and collection action for unpaid premiums.
In the event of an accident, theft, vandalism, natural disaster, or other covered loss, you must report the claim to Coskun Auto Insurance as promptly as possible. Many states impose specific timeframes within which an insured must report a loss, and failure to report promptly may jeopardize coverage. Claims may be reported through our online claims portal, by email to contact@coskunotomotivtrabzon.com, or through other channels specified in your policy documents and state-required notices.
When filing a claim, you will be required to provide detailed information about the incident, including the date, time, and location of the loss; a description of what occurred; the identities and contact information of all involved parties, witnesses, and law enforcement agencies; photographs of damage; police report numbers (if applicable); and any other documentation we reasonably request. For injury claims, you must also provide information about medical treatment received and authorize us to obtain relevant medical records as permitted by law.
Coskun Auto Insurance will assign a claims representative or adjuster to investigate your claim in accordance with our established procedures and applicable state unfair claims settlement practices acts. The investigation may include inspection of your vehicle, review of repair estimates, examination of police and accident reports, interviews with involved parties, coordination with other insurers in multi-party accidents, and consultation with medical providers or legal counsel where appropriate. You are required to cooperate fully with our investigation, which includes providing truthful statements, attending examinations under oath if requested (where permitted by law), and not authorizing repairs that exceed preliminary approval limits without our consent when required by your policy.
Coverage determinations will be made based on the terms, conditions, exclusions, and limits of your policy as of the date of loss. Payment of a claim, or any portion thereof, is not an admission of liability in any subsequent legal proceeding. We reserve the right to pursue subrogation against responsible third parties to recover amounts paid on your behalf. If you receive recovery from a third party for the same loss, you may be required to reimburse Coskun Auto Insurance for amounts we paid, less your deductible and a proportionate share of recovery costs, as specified in your policy's subrogation and recovery provisions.
Claim processing timelines vary depending on the complexity of the loss, the completeness of documentation, the involvement of other parties and insurers, and state regulatory requirements. We are committed to handling claims fairly and promptly and will communicate status updates through your preferred contact method. If you disagree with a coverage decision or settlement offer, you may request a review through our internal appeals process and, where applicable, pursue remedies available under your policy and state insurance regulations, including contact with your state department of insurance.
As a user of Coskun Auto Insurance Services and, where applicable, as a named insured or listed driver on a policy, you bear significant responsibilities that are essential to maintaining valid coverage and ensuring the integrity of our insurance operations. You agree to act in good faith in all interactions with Coskun Auto Insurance and to comply with all applicable federal, state, and local laws governing automobile operation, insurance, and financial responsibility.
You are responsible for providing complete, accurate, and truthful information at every stage of your relationship with us, including during quote requests, application submissions, policy renewals, endorsements, claims reporting, and any audit or verification process. This obligation extends to information about all drivers in your household, all vehicles you own or regularly use, your garaging address, vehicle usage (commuting, business, rideshare, etc.), prior insurance and claims history, and any material changes in circumstances that may affect your risk profile or premium. Material misrepresentation or omission may void coverage ab initio or from the date of the misrepresentation, depending on state law.
You must maintain your vehicle in safe operating condition and comply with all traffic laws and registration requirements in your state. You are responsible for paying your premiums on time, reviewing your policy documents and declarations pages upon receipt, understanding your coverage limits and deductibles, and notifying us promptly of any changes that require a policy endorsement. You must also take reasonable steps to mitigate loss after an incident, including protecting your vehicle from further damage and preserving evidence for claims investigation.
If you permit others to use your account or policy, you remain fully responsible for their actions and for ensuring they comply with these Terms and your policy conditions. Parents and guardians are responsible for the conduct of minor drivers listed on or covered under household policies. Business entities are responsible for ensuring that employees operating covered vehicles hold appropriate licenses and use vehicles in accordance with policy terms.
You agree to promptly respond to our requests for information, documentation, or cooperation in connection with underwriting, billing, claims, fraud investigation, or regulatory compliance. Failure to fulfill these responsibilities may result in denial of claims, policy cancellation, account termination, or referral to law enforcement or regulatory authorities where appropriate.
You may use the Site and Services only for lawful purposes and in accordance with these Terms. You agree not to use the Site or Services in any manner that violates applicable federal, state, or local law, regulation, or ordinance, or that infringes upon the rights of Coskun Auto Insurance or any third party. Prohibited uses include, without limitation, the following activities.
You may not submit false, misleading, or fraudulent information in connection with quote requests, applications, claims, or any other interaction with our Services. Insurance fraud is a serious crime under both federal and state law and may result in policy voidance, claim denial, civil penalties, criminal prosecution, and reporting to the National Insurance Crime Bureau (NICB) and appropriate law enforcement agencies. This prohibition includes staging accidents, exaggerating damages, misrepresenting facts of loss, concealing prior claims or violations, and providing altered or fabricated documentation.
You may not attempt to gain unauthorized access to our systems, networks, servers, databases, or other users' accounts through hacking, password mining, phishing, or any other means. You may not use automated tools, bots, scrapers, or data mining technologies to extract data from the Site without our express written consent. You may not use a personal auto policy for commercial purposes beyond incidental business use as defined in your policy, or for rideshare or delivery activities unless you have purchased appropriate coverage endorsements or commercial policies. Operating a vehicle in a manner excluded by your policy — such as racing, off-road use (unless covered), intentional acts, or use while committing a felony — is prohibited and may result in claim denial and policy cancellation. Coskun Auto Insurance reserves the right to investigate suspected prohibited uses and take appropriate action, including termination of access and referral to authorities.
The Site and its entire contents, features, and functionality — including but not limited to all text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, page layouts, design elements, and the selection and arrangement thereof — are owned by Coskun Auto Insurance, its licensors, or other content providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The Coskun Auto Insurance name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Coskun Auto Insurance or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners. Nothing in these Terms grants you any right, title, or interest in or to the Site or its content except for the limited license expressly set forth herein.
Subject to your compliance with these Terms, Coskun Auto Insurance grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and Services for your personal, non-commercial use in connection with obtaining and managing auto insurance. This license does not include any right to: reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Site, except as incidentally necessary to use the Services as intended; use any illustrations, photographs, video or audio sequences, or any graphics separately from accompanying text; or delete or alter any copyright, trademark, or other proprietary rights notices.
If you submit feedback, suggestions, ideas, testimonials, or other content to Coskun Auto Insurance through the Site, email, or other channels ("User Submissions"), you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Submissions in any media for any lawful purpose, including marketing and promotional activities, without compensation to you. You represent that you own or control all rights in your User Submissions and that our use of such content will not violate any third-party rights or applicable law.
We respect the intellectual property rights of others and expect users to do the same. To the fullest extent permitted by applicable law, Coskun Auto Insurance and its officers, directors, employees, agents, affiliates, successors, assigns, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of or inability to use the Site or Services, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for all claims arising out of or relating to these Terms or your use of the Site and Services — whether in contract, tort (including negligence), strict liability, or any other legal theory — shall not exceed the greater of: (a) the total amount of premiums you paid to Coskun Auto Insurance for the policy period during which the claim arose; or (b) one hundred United States dollars ($100.00). This limitation applies collectively to all claims and shall not be increased by multiple claims or parties.
The limitations set forth in this section do not limit or exclude liability for: (a) death or personal injury caused by our negligence where such limitation is prohibited by law; (b) our obligations under a valid and bound insurance policy, which are governed by the policy terms and applicable insurance law rather than these website Terms; (c) fraud, willful misconduct, or gross negligence; or (d) any other liability that cannot be excluded or limited under applicable law. Because some states do not allow the exclusion or limitation of incidental or consequential damages, portions of the above limitations may not apply to you.
The Site and Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content, quotes, or information obtained through the Site. Any reliance you place on such information is strictly at your own risk.
You acknowledge that the insurance products offered through our Services are subject to policy-specific terms, exclusions, and conditions, and that coverage disputes are resolved according to insurance contract law and regulatory frameworks, not general website terms. This Limitation of Liability section pertains primarily to your use of our digital platforms and ancillary services and is not intended to limit coverage obligations that arise under a duly issued insurance policy.
You agree to defend, indemnify, and hold harmless Coskun Auto Insurance and its officers, directors, employees, agents, affiliates, successors, assigns, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your violation of these Terms; (b) your violation of any applicable law, regulation, or third-party right, including intellectual property rights and privacy rights; (c) your use or misuse of the Site or Services; (d) any information or content you submit, post, or transmit through the Services; (e) your negligence, willful misconduct, or fraud; (f) any accident or loss involving a vehicle covered under your policy where you failed to comply with policy conditions or applicable law; or (g) any dispute between you and a third party arising from your use of the Services.
Your indemnification obligations apply regardless of whether the underlying claim is well-founded, and shall survive termination of your account, expiration or cancellation of your policy, and termination of these Terms. Coskun Auto Insurance reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate fully with our defense of such claims. You may not settle any claim subject to indemnification without our prior written consent.
To the extent that your auto insurance policy includes liability coverage that may apply to third-party claims arising from your use of a covered vehicle, such policy coverage shall be primary, and your indemnification obligations under these Terms shall apply to amounts not covered by insurance, deductibles, and any losses excluded from coverage. Nothing in this section requires you to indemnify us for our own gross negligence, willful misconduct, or violations of applicable insurance laws.
If you are a California resident, you waive California Civil Code Section 1542 in connection with any release or indemnification provision herein to the extent permitted by law. Section 1542 provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her would have materially affected his or her settlement with the debtor or released party."
These Terms and any dispute or claim arising out of or relating to these Terms, the Site, or the Services (except for disputes arising under a bound insurance policy, which are governed by the policy and the state of domicile or issuance as applicable) shall be governed by and construed in accordance with the laws of the United States and the laws of the State of Delaware, without regard to its conflict of law principles that would require application of the law of another jurisdiction.
You acknowledge that the Services are offered solely to residents of the United States and that Coskun Auto Insurance operates under the regulatory framework of U.S. federal and state insurance laws. Auto insurance policies issued by or through Coskun Auto Insurance are subject to the insurance code and regulations of the state in which the policy is issued, including mandatory policy provisions, rate filings, cancellation and non-renewal requirements, claims handling standards, and consumer protection statutes. Where state law mandates terms that differ from or supersede provisions of these Terms, the state law and policy terms shall prevail with respect to insurance coverage matters.
Federal laws that may apply to your use of our Services include, without limitation, the Gramm-Leach-Bliley Act (GLBA) governing financial privacy, the Fair Credit Reporting Act (FCRA) as it relates to credit-based insurance scoring, the Driver's Privacy Protection Act (DPPA) governing motor vehicle record information, the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) validating electronic transactions, the Telephone Consumer Protection Act (TCPA) governing communications, and the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM Act) governing commercial email. Coskun Auto Insurance is committed to resolving disputes with our customers fairly and efficiently. Before initiating any formal dispute resolution proceeding, you agree to first contact us at contact@coskunotomotivtrabzon.com and provide a written description of your concern, including your policy number (if applicable), the facts giving rise to the dispute, and the remedy you seek. We will attempt to resolve the matter informally within sixty (60) days of receiving your notice. This informal resolution process is a prerequisite to arbitration or litigation for disputes arising under these Terms, except where prohibited by applicable insurance regulations.
Except for disputes that qualify for small claims court jurisdiction and disputes arising under a bound insurance policy that are subject to state-specific insurance remedies (including appeals to state insurance departments and, where applicable, appraisal or mediation procedures outlined in your policy), any controversy or claim arising out of or relating to these Terms or your use of the Site and Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or such other arbitration forum and rules as we may designate and as permitted by law. The arbitration shall be conducted in English and held in a location mutually agreed upon or, failing agreement, in the state of your residence or the state where your policy was issued.
You and Coskun Auto Insurance agree that arbitration shall be conducted on an individual basis only. Neither party may bring or participate in a class action, class arbitration, private attorney general action, or consolidated proceeding against the other. The arbitrator may award only individual relief and may not consolidate claims or preside over any form of representative proceeding. If a court determines that any part of this class action waiver is unenforceable, the remainder of this arbitration agreement shall remain in effect.
The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. Each party shall bear its own attorneys' fees and costs unless the arbitrator awards fees and costs to the prevailing party as permitted by applicable law. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent unauthorized use or abuse of intellectual property, confidential information, or the Site, without first engaging in arbitration.
Disputes regarding insurance coverage, claim denials, premium calculations, and policy interpretation are primarily governed by your insurance policy and applicable state insurance law, which may provide remedies including internal appeals, review by state insurance regulators, and judicial proceedings in state courts. Nothing in this section limits your right to file a complaint with your state department of insurance or to pursue remedies expressly preserved under your policy or state insurance code.
Coskun Auto Insurance reserves the right to modify, amend, or replace these Terms at any time at our sole discretion. When we make material changes to these Terms, we will post the updated version on the Site with a revised "Last updated" date and, where appropriate, provide additional notice through email, account notifications, or prominent banners on the Site. It is your responsibility to review the Terms periodically for changes.
Material changes to these Terms will become effective upon posting unless a later effective date is specified in the notice. Your continued use of the Site or Services after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Site and Services. For users with active insurance policies, changes to these website Terms do not alter the terms of your bound policy during the current policy period; policy changes are subject to separate endorsement and notice requirements under applicable state insurance law.
We may also update, modify, or discontinue features of the Site or Services without amending these Terms, provided such changes do not materially reduce your rights under an active policy. Non-material changes, such as clarifications, formatting updates, or corrections of typographical errors, may be made at any time without prior notice. The version of the Terms in effect at the time you access the Site governs your use, except that policy-related obligations are governed by the policy version in effect at the time of issuance or renewal.
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
